Aged Care & Other Legislation Amendment

On 2 August 2022, the Australian Government passed the Aged Care and Other Legislation Amendment (Royal Commission Response) Bill 2022. The first legislation to pass in the new Parliament, the Bill implements nine measures to improve aged care and responds to 17 recommendations of the Royal Commission into Aged Care Quality and Safety.

The Bill establishes the Australian National Aged Care Classification (AN ACC) funding model, a new Code of Conduct and banning orders, and extends the Serious Incident Response Scheme to all in-home care providers. It also extends the functions of the Independent Health and Aged Care Pricing Authority, which will lead to better price-setting for aged care.

Other measures enshrine transparency and accountability of approved providers, and improve quality of care and safety for older Australians receiving aged care services.

We share our thoughts on how these new reforms affect the advisory board sector.

Advisory Bodies for the Aged Care Sector

Aged care providers gain access to dedicated professionals and best practice methods for effective implementation of quality care and consumer advisory bodies.

How can we help?

  • Free access to the best practice framework to support their advisory bodies. Download here
  • Free access to the Advisor Concierge service to scope your needs and connect with professionals to support implementation
  • Resources and education through the Aged Care Certified Chair Executive Program. This includes membership to the aged care best practice benchmarking community.
  • Foundations e-learning program for your Board and your team in understanding the role of advisory bodies and best practice.

Advisory Bodies:

  • Do provide access to specialist or strategic insights, robust analysis and critical thinking. They are not legislated or regulated by the Corporations Act
  • Can operate in accordance with a Best Practice Framework and Charter that sets out the bodies’ structure, participation, and operations
  • Are not authorised to act or make binding decisions on behalf of the organisation and do not have fiduciary responsibility

They help to avoid:

  • Widely varying implementation approaches that put policy objectives at risk
  • Lost time and money from over-training advisors with governance board training
  • Poor quality consumer engagement
